How do I obtain full child custody in missouri if the father is completely willing to sign over his rights?

Jessica asked:

I am the mother of a newborn. The father wants nothing to do with the baby and I am not requesting any child support or anything from him. Do I need to go to court to obtain full custody or can he just sign forms over since he’s completely willing?

I would make sure this is absolutely what you want and make it legal, that way later on down the road he can’t come back on it

Well if you are on WIC or some sort of state/county assistance you are required to submit to them the father’s information, although you could lie and say you can’t find him and they will give you assistance anyway.

It is sad that he doesn’t want anything to do with you or the baby, but then again we don’t know you guys history, if there is one.

The most simple thing to do is go to court, he obviously won’t show and just get full custody. You have to get with a lawyer to find out if he can sign his rights away without paying child support, because the laws say that it is a parent’s responsibility no matter what.

You will probably need a lawyer, and you definitely need to make sure that whatever he signs meets the legal requiements in Missouri. When I went thru the whole custody issue I found a book written by 2 custody experts to be incredibly helpful. They give quite a bit of info on their website as well. You might want to take a look and see if you think the book would be helpful. The link to their website is below. Good Luck.
